Terms and Conditions of Service

These Terms and Conditions (“Agreement”) govern the relationship between the client (“Customer”, “You”, or “Your”) and Rainbow Events Brisbane By KC (“Company”, “We”, “Our”, or “Us”).
By paying any portion of an invoice, the Customer confirms that they have read, understood, and agree to be legally bound by these Terms and Conditions in full.

1. Payment Terms

a. Special Pricing & Standard Packages
i. For total amounts up to $600 (excluding delivery fees and any applicable damage bond), full payment is required upfront to secure the event date.
ii. For packages exceeding $600, a minimum 50% non-refundable retainer is required to secure the event date, with the remaining balance payable no later than seven (7) days prior to the event date.
iii. Custom packages may require a retainer greater than 50%, reflecting the nature and cost of custom work.
b. Retainers
i. All retainers are strictly non-refundable under all circumstances.
ii. Payment of a retainer constitutes confirmation of the booking and reservation of the event date.
c. Invoice Review & Damage Bond Confirmation
Customers are responsible for reviewing their invoice carefully prior to payment.
If an invoice does not contain a separate line item labelled “Damage Bond”, then no damage bond has been taken.
The absence of a damage bond does not limit or reduce the Customer’s liability for damage, loss, or replacement of hired items.

2. Cancellation Policy (Strict – No Refunds)

a. All cancellations are strictly non-refundable, regardless of reason, including but not limited to change of mind, illness, adverse weather, venue issues, government restrictions, or personal circumstances.
b. No cash refunds, chargebacks, or payment reversals will be issued under any circumstances.
c. Where a cancellation occurs, the Customer may be offered a credit only, subject to all of the following conditions:
  • The credit applies only to the exact items and services originally paid for
  • Credits are non-transferable and cannot be exchanged, downgraded, or substituted
  • Credits must be used within twelve (12) months of the original event date
  • Any price increases after the original event date must be paid by the Customer
  • Use of the credit is subject to availability and scheduling at the discretion of Rainbow Events Brisbane By KC
d. Credits not used within the twelve (12) month validity period will automatically expire with no extension, refund, or replacement.

3. Change of Event Date

a. One (1) date change may be permitted at the discretion of Rainbow Events Brisbane By KC, provided the request is made more than seven (7) days prior to the original event date.
b. Any additional date changes will incur a $100 change fee per request.
c. All date changes must be confirmed in writing via email.
d. Date changes do not reset or extend the twelve (12) month credit validity period.

4. Change of Mind

a. No refunds are provided for change of mind under any circumstances.
b. Credits, if offered, are governed strictly by Clause 2.
c. All credits are non-transferable and may only be used by the original purchaser.
d. Services already provided or commenced are not eligible for refund or credit.

5. Event Conditions

a. Events must be held indoors or under fixed, weather-protected structures unless otherwise approved in writing.
b. Rainbow Events Brisbane By KC is not liable for balloon popping, deterioration, or damage caused by heat, wind, rain, or other environmental factors.
c. Items suitable for limited outdoor use include Organic Balloon Arches, Spiral Balloon Arches, and Balloon Columns only.

6. Damages and Loss

a. The Customer is fully responsible for all hired items from delivery until collection.
b. Any damage, loss, theft, misuse, or unauthorised handling will be charged to the Customer.
c. The Customer’s liability applies whether or not a damage bond has been taken.
d. Failure to report damage within one (1) hour of discovery may result in full liability for repair or replacement costs.

7. Extension of Hire Period

a. Hire period extensions require prior approval and may incur additional fees.
b. The Customer remains fully liable for all items during any extended hire period.

8. Movement of Hired Items

a. Hired items must not be moved without prior written approval.
b. Where items are moved by the Customer, guests, venue staff, or third parties, the Customer remains fully liable for all resulting damage or loss.

9. Hire Items

a. Full payment is required upfront for all hire items.
b. Standard hire periods are 4–6 hours unless otherwise specified.
c. All hired items remain the property of Rainbow Events Brisbane By KC at all times.

10. Minimum Spend

A minimum spend of $390 applies to balloon and hire items, excluding delivery fees and any applicable damage bond.

11. Visual Designs & Mock-Ups

a. All visual designs and mock-ups are non-refundable and not eligible for credit.
b. All designs remain the intellectual property of Rainbow Events Brisbane By KC.

12. Reservation of Date

Event dates are reserved only upon receipt of the required payment or retainer.

13. Rush & Last-Minute Bookings

Rush and last-minute booking fees apply where relevant and are strictly non-refundable.

14. Prices

All prices are subject to change without notice.

15. Set Up & Pack Down

Set-up and pack-down times are confirmed prior to the event and are subject to venue access and conditions.

16. Stairs & Lift Access

Failure to disclose stairs, lift restrictions, or access limitations may result in surcharges or immediate cancellation without refund or credit.

17. Reviews

Defamatory, misleading, or false reviews may result in legal action.

18. Online Bookings

Rainbow Events Brisbane By KC reserves the right to accept or reject any booking at its discretion.

19. Damage Bond & Liability for Damage or Loss

a. A damage bond is not required for all bookings and may be requested at the sole discretion of Rainbow Events Brisbane By KC based on items hired, event type, venue conditions, access, and risk assessment.

b. A damage bond is only deemed to have been taken if it is clearly itemised as a separate line item on the Customer’s invoice.
If no such line item appears, no bond has been taken, regardless of any verbal discussion or assumption.

c. Where a damage bond has been taken, it may be applied toward minor damage, loss, excessive cleaning, or repair costs.
If repair or replacement costs exceed the bond amount, the Customer agrees to pay the balance in full.

d. Where no damage bond has been taken, the Customer accepts full financial responsibility for any damage, loss, theft, or destruction of hired items occurring during the hire period, regardless of cause or fault.
e. Where damage occurs and no bond has been taken, Rainbow Events Brisbane By KC will issue a repair or replacement invoice, which must be paid in full within seven (7) calendar days of invoice issue or the damage occurring (whichever occurs first).
f. Failure to pay may result in debt recovery action, including recovery fees, legal costs, and administrative charges, all payable by the Customer.
g. Liability includes damage caused by guests, children, venue staff, contractors, third parties, weather exposure, or unauthorised movement of items.
h. Where a damage bond has been taken, it will be refunded only after inspection confirms all items are returned in acceptable condition. Bond refunds may take up to fourteen (14) days to process.

20. Acceptance of Terms

By paying any portion of an invoice, the Customer confirms acceptance of these Terms and Conditions in full.
